PIP Insurance

Under Florida law, regardless of whose fault the automobile accident is, your own PIP must pay out first for personal injury. In fact, this is the only type of insurance that is required under the law. It pays 80% of the first $10,000.00 of medical treatment, minus your deductible. However, you must seek medical treatment within the first 14 days of your accident, or your own insurance company can deny coverage. Therefore, it is important that you seek medical care immediately after an accident.

Hopefully that at-fault driver has what is called BI insurance. This insurance covers insured drivers when they cause injuries in an automobile accident. Insured drivers can choose their coverage. They may not have this coverage at all, or they may have a policy for $10,000.00 or as much as 1 million dollars. When someone causes an accident, an injured party can demand that the at-fault’s BI pay for their damages.

uninsured motorist insurance (UM)

If an at-fault driver does not have BI, hopefully the injured driver has what is called UM insurance. This insurance applies for exactly this situation. When an injured party who is not at-fault is not able to have his/her damages compensated because the at-fault driver does not have BI, then his/her UM policy can pay for his/her damages. This policy also applies when the BI policy is not enough to pay for the damages. Then the injured driver can also deman their own UM policy to pay the remainder of the damages.
